Toronto Lawyer Battles City Hall To Marry

(Toronto)  Gay and lesbian couples in Ontario may have the same rights as hetrosexual couples but they are still prevented from marrying. Toronto lawyer Michael Leshner is pressing the issue.  And, it could end in the Supreme Court of Canada.

Leshner went to Toronto City Hall Friday to get a marriage licence, and was rejected.  Leshner is pressing the city clerk to provide a written rejection.  Once he gets it, it will be entered into evidence in a court battle that will likely travel to the Supreme Court of Canada.

Leshner and another gay lawyer, Martha McCarthy, along with 12 other people are filing court papers this week.

When the Supreme Court of Canada ruled that Ontario's Family Law Act discriminated against gays and lesbians, the Ontario government enacted legislation that provided for equal treatment for gay couples, but created a separate category for common law relationships.  The new law is similar to one later enacted in Vermont.

While gays and lesbians praised the move at the time, they warned they would press for full rights that included marriage.
